Tamil Nadu government relaxes norms for institutional, industrial development of OSR lands

The Tamil Nadu government has relaxed norms in respect of institutional and industrial developments regarding the OSR lands that are to be earmarked for community recreational purposes.

As per the recent amendment to the Tamil Nadu Combined Development and Building Rules, 2019, the OSR land need not abut a public road if it is connected through internal roads, pathways, among others.

According to the recent amendment to the rules, in respect of Institutional Developments and Industrial Developments, the gifting of the land earmarked for community recreational purposes (OSR) to the local body shall not be insisted upon. The space shall be maintained by the land owner subject to the supervision and monitoring of the concerned local body. “It shall also not be mandatory for such land to abut a public road provided that adequate and safe access is ensured by proper spatial planning through internal roads, pathways, or other means.”

Tamil Nadu Combined Development and Building Rules, 2019, the explanation to Rule 41 said that the gifting of the reservation of land for community recreational purpose in respect of institutional developments and industrial developments to the local body was not required. However, the space may be maintained by the owner concerned subject to the supervision and monitoring of the local body concerned, it clarified.

In January 2020, the government made an amendment to the relevant section and said reservation of land for community recreational purpose in respect of institutional developments and industrial developments abutting a public road need not be insisted on in order to provide flexibility to the owner. In December last year, the government has further amended the relevant section and has further relaxed norms and said OSR land need not abut a public road.
