Hyderabad police revive externment orders to stop repeat offenders

Hyderabad City Police are reviving the use of externment orders under Section 26 (1) of the Hyderabad City Police Act, 1348 Fasli, as a measure to control repeat offenders and maintain public safety in the city.

The provision allows the Commissioner of Police to direct individuals to leave the city or follow specific preventive measures, if their presence is likely to cause danger, alarm, or harm to life or property.

Hyderabad Police Commissioner C.V. Anand said, “An order for externment has not been issued in ages. We have studied the provision carefully and are implementing it again. I have asked my officers to revive all notices and legal aspects. If needed, this will definitely be used more.”

As per the City Police Act, the power is applicable when an individual is suspected of intending to disturb public peace, or when witnesses are too fearful to give evidence publicly. It can also be invoked in cases where a person’s continued residence may lead to outbreaks of epidemic diseases.

Orders can be issued against those repeatedly convicted of offences under certain chapters of the Indian Penal Code or the Gambling Act. A copy of the order is also sent to the Chief City Magistrate.

Externment notices are part of the city police’s broader strategy, which includes patrols, intelligence gathering, and community policing, to prevent criminals from regrouping and disrupting organised crime networks. Police have emphasised that these orders are preventive and legal, intended to protect residents and maintain law and order.

Mr. Anand added, “We will monitor compliance closely. If a person violates the order, action will be taken accordingly. In some cases, like that of repeat offenders, the individual’s life may also be at risk, and relocation can be a protective measure as well.”
