HC reserves orders in Bandi Bageerath’s bail plea in POCSO Act case

Justice K. Sujana of the Telangana High Court on Monday reserved orders in the criminal petition seeking regular bail filed by Union Minister of State for Home Bandi Sanjay Kumar’s son Bandi Bageerath in a case registered under the Protection of Children from Sexual Offences (POCSO) Act.

As the arguments by the senior counsel for the petitioner S. Niranjan Reddy, the Public Prosecutor for Home Palle Nageshwara Rao and the counsel for the victim’s mother (complainant in the case) Pappu Nageshwara Rao ended, the judge reserved the orders in the case. The petitioner’s counsel contended that Mr. Bageerath had been imprisoned for more 49 days.

The police officials completed the investigation and the chargesheet was to be filed in the case. At this stage, there was no need to keep his client in prison; he argued. He told the bench that nowhere in the complaint was it mentioned that the victim was subject to sexual assault.

He said the provisions of the POCSO Act cannot be applied to the present case since the alleged accused and the victim were in good terms till registration of the case. Already, 22 witnesses were examined by the investigators in the matter, he said.

The Public Prosecutor for Home vehemently opposed the granting of bail to the accused, arguing that there were more chances of the accused tampering with the evidence and attempting to influence the witnesses if released on bail.
