The Supreme Court on Monday (October 12, 2026) highlighted the need to balance religious sentiments with public health concerns while considering restrictions on firecrackers in the national capital and neighbouring regions.

“We will not hurt religious sentiments but at the same time, people should themselves come forward and opt for it. The whole exercise should involve a balancing approach,” Chief Justice of India Surya Kant, heading a three-judge Bench, said.

During the hearing, Justice Joymalya Bagchi questioned the religious basis for bursting firecrackers.

Health risks

Senior advocate Aparajita Singh, who is the amicus curiae in the case, expounded on the health risks associated with air pollution, particularly for children, senior citizens, and those suffering from health vulnerabilities. Ms. Singh suggested that the Commission for Air Quality Management (CAQM), the statutory body responsible for air quality management in the region, should be asked to turn its attention to the medical concerns related to air pollution.

The Bench, however, cautioned against imposing restrictions that could prove difficult to enforce on the ground. “We have to make people wiser, bring awareness, and tell them which firecrackers are harmful and which are less harmful,” the CJI said.

He suggested promoting a culture centred on traditional practices, such as lighting lamps and using sparklers, along with restrictions on the availability of more harmful cracker varieties.

The matter will be heard next on October 15.
