The Kerala High Court has stayed for a month an order of the State Information Commission directing the Kerala Public Service Commission to disclose records of a recruitment examination to the Kerala State Planning Board.
The information commission had directed the PSC to furnish marks secured by the candidates, copies of the experience certificates of candidates ranked first and second, and also records of the interview marks in the selection conducted by the PSC.
The PSC had contended before the commission that the information sought (by the third rank holder) consisted of personal information and documents of third parties, and that no larger public interest was established to justify the disclosure. But the commission directed the PSC to furnish the said information.
Challenging this before the High Court, the PSC submitted that the commission’s order was contrary to the provisions of the RTI Act and the privacy rights of third parties. Moreover, the PSC dealt with the recruitment processes of 1.25 crore candidates.
It was not practical to furnish such personal credentials and other documents submitted by candidates. Aimed at transparency, the PSC published marks of candidates in the written examination and interview, along with the rank list, after completing the entire selection process, it said.
The third rank holder contended that the PSC’s reluctance to disclose exam related matters was against the RTI Act.
After hearing the parties, the court posted the matter for hearing on September 10.
