The High Court of Karnataka on Friday directed the Karnataka Examinations Authority (KEA) not to publish till November 3 the final allotment of seats to medical and dental courses in the third round of counselling based on the provisional allotment list published on October 24.
As a Division Bench comprising Justice Jayant Banerji and Justice K.V. Aravind extended this interim order till November 3, the KEA now will not be able to meet November 1 deadline, set by the Medical Counselling Committee (MCC), New Delhi, for completing the third round of seat allotment process for medical and dental courses.
The KEA, in its October 24 provisional allotment list of third round had notified that the final allotment list would be published on October 27.
On November 3
The Bench will now continue hearing on November 3 on the petitions, filed by a batch of students, who had already secured a medical seat in the first or second round and had joined the college. The petitioners have questioned the procedure adopted by the KEA in not allowing them to claim vacant seats available in other colleges by exiting seats in the present college even though they have better ranks than those students who have been provisionally allotted seats in the third round.
However, the KEA in its statement of objection filed through its advocate, N.K. Ramesh, pointed out to the bench that in 2023 all students, including those who had joined medical colleges on allotment of seats either in the first round or the second round, were allowed to participate in the third round.
However, the High Court, in the case of Hitashree Y.L. Vs KEA had “held that the candidates who have already been allotted seat and joined the college cannot be permitted to participate in the 3rd/mop-up round,” the KEA said in its statement while pointing out that due to this judgement the KEA is not allowing the already admitted students to claim vacant seats in the third round.
