The Delhi High Court has passed a significant order on actress Janhvi Kapoor’s personality rights petition. The court has directed the removal of obscene and pornographic content concerning her available online, but refused to order the blanket removal of all fan pages and URLs associated with her name or identity.
Janhvi Kapoor gets partial relief as Delhi HC orders removal of obscene content
Janhvi Kapoor’s personality rights case involved around 6,884 URLs. Janhvi had sought the removal of all these URLs. However, Justice Anup Jairam Bhambhani said that all content could not be treated in the same manner and a blanket takedown order could not be issued.
However, the court directed the removal of 552 URLs. During its preliminary examination, the court found that the content on these URLs appeared to be highly obscene or pornographic.
What did the court say about fan pages?
The court made it clear that every fan page operating in a celebrity’s name is not automatically illegal. Such pages may contain photographs, videos, film-related information, praise or criticism. The court questioned how all fan clubs could be shut down simply because they use a celebrity’s name or image.
However, action can be taken against a page if it carries obscene content or uses a celebrity’s identity to make money.
Case also involved AI-generated fake content
Janhvi’s petition reportedly also raised the issue of alleged AI-generated images/deepfakes, impersonation accounts and obscene content. The court said that such serious and clearly objectionable content should be considered separately.
