Inter-university transfer can be ordered only with consent of teacher: HC

The Kerala High Court has observed that inter-university transfer of assistant professors in colleges under Mahatma Gandhi University can only be made with their consent.

Justice N. Nagaresh made the observation recently while quashing the transfer of Sangeetha S., assistant professor working in Devaswom Board Pampa College, Parumala, to DB College, Sasthamcotta. According to the petitioner, inter-university transfer shall be made only on the written request of the teacher who has completed three years of service. In the petitioner’s case, the transfer is ordered without obtaining her consent.

The court observed that in view of Section 68A of Mahatma Gandhi University Act, 1985, an inter-university transfer can be ordered only on getting consent from the teacher. The petitioner had not made any request for any inter-university transfer. Therefore, the transfer is illegal. Besides, the transfer order has serious consequences. The petitioner will become the junior most teacher in the transferred station.
