The Supreme Court on Monday (May 4, 2026) issued notice to the Union Government and States on multiple petitions challenging the Transgender Persons (Protection of Rights) Amendment Act, 2026.
The petitions have argued that the amended law raises the fundamental question whether the state, through the instrument of legislation, could define the sexual identity of a person, and “in so doing, substitute its own biological or sociomedical classification for the lived, autonomous, and self-perceived identity of a human being”.
