HC asks under what authority of law breath analyser test held on advocate

Justice E.V. Venugopal of the Telangana High Court on Friday sough to know from the Punjagutta police station Inspector Ramakrishna under what authority of law the latter had subjected an advocate Subba Rao, who visited the police to inquire about a case, to breath analyser test. 

Hearing a writ petition filed by the advocate, the judge also wanted to know what were the reasons that resulted in a disturbance compelling the police to conduct the test. Justice Venugopal noted that the video clip presented by advocate V. Raghunath, appearing for the petitioner, demonstrated that Subba Rao was subjected to breath analyser test which was “unknown to law”.
