Trial court concludes that prosecution failed to prove charges against actor Dileep in 2017 actor rape case

The prosecution in the 2017 actor rape case failed to prove that actor Dileep conspired with ‘Pulsar’ Suni, the first accused, and gave the quotation to humiliate and sexually assault and capture the nude video of the survivor in the case, the Sessions Court has found.

The court had the other day acquitted Mr. Dileep and three others after it found that the prosecution had failed to prove the charges levelled against him.

The prosecution’s case was that the actor conspired with the accused to take revenge against the woman actor for defaming him and wrecking his marital life. The charges levelled against the first six accused and Mr. Dileep included gang rape, criminal conspiracy, outraging the modesty of a woman, wrongful confinement, use of criminal force, destruction of evidence, taking and distributing obscene images.

Six convicts were sentenced to rigorous imprisonment for 20 years by the trial court on Friday.

The trial court rejected the contentions of the prosecution that data was deleted from the phone of Mr. Dileep to destroy evidence from the phone and, thereby, caused the disappearance of evidence. The judge concluded that the prosecution failed to prove the allegation that Mr. Dileep deleted data connected with the case from his mobile phone and thereby caused the disappearance of evidence.

The evidence of Prosecution Witnesses 192 and 216 showed that no deletion of data, as stated by the prosecution, took place in the mobile phone of Mr. Dileep. The court held in its judgment that ran into more than 1,700 pages.

The court held that it was not in a position to arrive at a conclusion that Mr. Dileep had created a WhatsApp group with ulterior motives and to mislead the court, and also to create the impression among the public that he had been falsely arraigned in this case.
