A.P. police to appeal against Bihar court order rejecting transit remand of IPS officer Sunil Kumar Naik

The Andhra Pradesh police are planning to appeal against the order of a Bihar court that rejected the transit remand of Bihar cadre IGP, M. Sunil Kumar Naik, in the alleged custodial torture of former Narsapuram Parliament Member K. Raghu Ramakrishna Raju.

“We will move an upper court to vacate the order of the jurisdictional court, which turned down the transit remand of the IGP,” a senior police officer told The Hindu on Tuesday.

A team of the Andhra Pradesh Police took Mr. Sunil Kumar Naik, who is the Director of Fire Services of Bihar, into custody at his residence in Patna on Monday in the alleged custodial torture, five years ago, of Mr. Raghu Ramakrishna Raju, who is now the Deputy Speaker of the A.P. Legislative Assembly. He was produced in a local court seeking permission to shift him to A.P., but the plea was rejected.

Mr. Sunil Kumar Naik, who served on deputation as the DIG of the A.P. Crime Investigation Department (CID) at that time, was named as Accused No. 7 in the case registered in the Nagarampalem police station in Guntur district.

Meanwhile, it was alleged that the A.P. police entered the house of Mr. Sunil Kumar Naik by scaling the wall and took him into custody without producing the arrest warrant, though he insisted on producing it.

The jurisdictional court rejected the transit warrant on the ground that the A.P. Police did not follow the due inter-State arrest procedure.
